Membership Terms and Conditions 

If you would like to cancel your Premier Fitness membership at the of the current month, please put this in writing to info@elsc.london by 21st of the month.

1 FSSM Ltd (Eric Liddell Sports Centre) 

1.1 FSSM Ltd is a company limited by guarantee and.

1.2 It is registered in England and Wales. Its registered office address is C/O Bursars Office. Eltham College, Grove Park Road, London, SE9 4QF. Its company registration number is 03113910. Its VAT registration number is: 690723227.

2 Application of Terms and Conditions

2.1 These terms and conditions (“Terms and Conditions”) shall apply to all members of FSSM Ltd (“Eric Liddell Sports Centre”)

3 Acceptance of Membership

3.1 An individual wishing to become a member of Eric Liddell Sports Centres shall complete and sign a membership application Form.

3.2 The decision to accept the application of a potential member shall be at the sole discretion of Eric Liddell Sports Centre. Eric Liddell Sports Centre reserves the right to verify, or require proof of all information given in order to obtain membership. Any fraudulent or wrongful information given in order to obtain such membership could result in cancellation of membership and all membership rights and the repayment of all monies due to Eric Liddell Sports Centre.

3.3 If the membership application is accepted by Eric Liddell Sports Centre, membership of the leisure facilities shall commence upon the receipt of the appropriate membership fee.

3.4 A membership card shall be issued by Eric Liddell Sports Centre to all members. The membership card shall remain the property of Eric Liddell Sports Centre. The membership card shall entitle the member to all the rights and privileges exercisable by that category of member. Membership cards should be shown on entry to a Leisure Facility. Membership cards must only be used by the registered member. Eric Liddell Sports Centre reserves the right to cancel forthwith with no refund of membership if it is found that a member has used their membership card fraudulently. Eric Liddell Sports Centre may charge for replacement membership cards where membership cards are lost or damaged.

3.5 The acceptance by Eric Liddell Sports Centre of an application for membership of the leisure facilities shall constitute a legally binding agreement between the member and Eric Liddell Sports Centre. The member hereby agrees also to be bound by these terms and conditions and by any rules, bylaws and regulations of all or any of the leisure facilities which are in force at the time and as notified to the member by Eric Liddell Sports Centre.

4 Cancellation of Membership

4.1 A member may cancel their membership within fourteen (14) days of the date of the signed membership application form by writing to Eric Liddell Sports Centre. The member shall be entitled to a refund of the membership fee paid less a pro rota sum for the number of day’s membership prior to cancellation. Any administration fees paid shall not be refunded. In the event that a member wishes to re-join as a member of Eric Liddell Sports Centre following the cancellation, termination or expiry of membership, then subject to Eric Liddell Sports Centre approving the application, Eric Liddell Sports Centre reserve the right to charge an administration fee for processing the application.

4.2 If a member gives notice to cancel their membership by the 21st of the month, then there shall be nothing more to pay and membership shall terminate at the end of that month, subject to the minimum term in 5.3.

4.3 If a member gives notice to cancel their membership after the 21st of the month, then the member shall be liable to pay the direct debit fee in the following month with termination of membership effective from the end of that month. If Eric Liddell Sports Centre is unable to collect the direct debit fee on the due date membership shall be ‘frozen’ i.e. no access shall be allowed until the due fees are paid.

5 Membership Categories

5.1 All categories of membership shall be subject to these terms and conditions and to the rules, bylaws and regulations of all or any of the leisure facilities which are in force at the time as notified to the member by Eric Liddell Sports Centre.

5.2 Junior members shall be required to transfer their membership to a suitable product on the date of their 16th birthday. No benefits specifically applicable to members under 16 years old shall be transferred at time of after the member’s 16th birthday.

5.3 Members must notify Eric Liddell Sports Centre of any changes to the member’s details including email address to enable Eric Liddell Sports Centre to update its records and communicate effectively with members.

5.4 Eric Liddell Sports Centre reserves the right to manage any debts through internal credit control or external agencies and to charge an administration fee for any costs incurred in recovering unpaid membership fees. Interest shall be charged on late payment of membership fees.

5.7 Memberships cannot be cancelled during the specified membership term.

6 Initial Fee & Monthly Membership Charges

6.1 All members shall pay all membership fees irrespective of actual usage of the leisure facilities. For the avoidance of doubt, membership fees shall not be refunded if a member chooses not to use all or any of the leisure facilities.

6.2 If a member joins 8 days before the end of the month, the member shall pay a proportion of the first month’s fee with the direct debit fee commencing on the first day of the following month. If a member joins within 8 days of the end of the month, the member shall pay a proportional fee of the remaining month, plus the entire following month’s fee (i.e. up to 6 weeks). The direct debit fee shall commence on the first day of the subsequent month.

6.3 All monthly payments shall be paid by direct debit and are payable in advance.

6.4 All partner and group memberships can only be processed through one bank account, and therefore one direct debit mandate.

6.5 Membership prices are reviewed from time to time. Eric Liddell Sports Centre shall notify members of any such changes at least ten (10) working days in advance.

7 Suspension of Membership

7.1 Suspension of membership shall be at the discretion of Eric Liddell Sports Centre.

7.2 Subject to Clause 7.1, advanced members may suspend their membership for a minimum period of one month to a maximum period of three months. Monthly Direct Debit members may suspend their membership for a minimum period of one month and a maximum period of six months. All suspensions must be full calendar months.

7.3 To request a suspension, a member must email the manager of Eric Liddell Sports Centre by no later than the 21st of the month prior to the month suspension starts. The member shall be notified at the earliest opportunity if the application is accepted. A ‘freeze fee’ shall be payable in advance at Eric Liddell Sports Centre.

7.4 In the event of the member being unable to use their membership due to medical conditions, then a request for suspension should be made by writing to the Manager of the Eric Liddell Sports Centre together with appropriate and relevant supporting evidence. The decision to accept any request is at the sole discretion of the Manager of Eric Liddell Sports Centre.

7.5 Other flexible payment terms may be available from time-to time at the sole discretion of Eric Liddell Sports Centre.

8 Expulsion of Members or Termination of Membership by Eric Liddell Sports Centre

8.1 Eric Liddell Sports Centre may expel members or may terminate the membership of any member without notice and with immediate effect if:

8.1.1 the members conduct, whether or not such conduct is the subject of complaint by another member or group of members, is such that in the reasonable opinion of Eric Liddell Sports Centre, it may be injurious to the character, name or interests of the Eric Liddell Sports Centre and/or all or any of its facilities or is such that it renders the member unfit to associate with other members of all or any of the facilities;

8.1.2 if the members have committed any breach of these Terms and Conditions or the rules, bylaws and regulations of all or any of the facilities as in force from time to time; or 8.1.3 by notice in writing if any part of the annual, or monthly, membership charge which is due and payable remain unpaid five (5) days after the due date for payment.

8.2 A member, whose membership is terminated by Eric Liddell Sports Centre, shall forfeit all the privileges of membership with immediate effect without an entitlement to any claim for any refund of their annual membership fee on termination of their membership card.

9 Changes to Membership Categories

9.1 Eric Liddell Sports Centre shall give not less than one month’s prior written notice including by email to all members if Eric Liddell Sports Centre shall discontinue any of its membership categories and/or schemes.

10 Changes to Leisure Facilities

10.1 Members are required to pay for all activities outside of their membership category, and must have a valid ticket for use.

10.2 Members will be charged for any activity not cancelled within 48 hours and membership shall be frozen until due

fees are paid.

10.3 Eric Liddell Sports Centre reserves the right to make reasonable alterations to the range of activities provided without notice and Eric Liddell Sports Centre shall not be liable for any inconvenience caused by building works and for the provision of essential maintenance and improvements.

11 Changes to Opening Hours

11.1 The facilities normal opening hours are available from Eric Liddell Sports Centre on request. Such hours may be extended or reduced at the absolute discretion of Eric Liddell Sports Centre with or without any prior notice being given to members. Eric Liddell Sports Centre shall take all reasonable steps to give members reasonable notice of change to such hours.

11.2 On occasions when necessary maintenance is required, the facilities may be closed, for which members shall be given at least fourteen (14) days’ prior notice of any such closure.

11.3 On occasions when emergency repairs or maintenance is required, the facilities may be closed with immediate effect, without notice.

11.4 Eric Liddell Sports Centres peak opening times apply Monday – Thursday 6-9pm and Saturdays 7-12pm.

12 Assignment Clause

12.1 Eric Liddell Sports Centre may assign the benefit of these terms and conditions of membership to a third party on similar terms and conditions without notice being served upon the member to that effect.

13 Physical Health of Member

13.1 The member warrants and represents that they are in good health and are not knowingly incapable of engaging in either active or passive physical exercise. The member further warrants that such exercise would not be detrimental in any way to their mental or physical health, comfort, condition and/or wellbeing.

13.2 Members must ensure that they are competent prior to using health and fitness and other equipment including any new health and fitness and other equipment introduced during the membership period. At the point of joining, the member shall be requested to complete an induction to ensure competency using health and fitness and other equipment. There shall be an opportunity for the member to waive their right to complete this induction and accept personal responsibility for their competency and health condition. Eric Liddell Sports Centre staff are available upon request to familiarise members before use of any new health and fitness or other equipment which may be introduced during the membership period.

14 Limitation of Liability

14.1 The member acknowledges that Eric Liddell Sports Centres obligations and liabilities in respect of the Leisure Facilities are exhaustively defined in these Terms and Conditions.

14.2 The member is entirely responsible for the consequences of any use of all or any of the leisure facilities including all areas within the Leisure Facilities and associated equipment. Eric Liddell Sports Centre shall not be liable for any direct, indirect or consequential loss, damage, costs, expenses, theft or damage to property, whether arising under contract, tort (including negligence) or otherwise.

14.3 Eric Liddell Sports Centre accepts liability to the extent that it results from the negligence of Eric Liddell Sports Centre and/or its employees for death or personal injury of any member without limit.

15 Privacy and Data Protection Policy of FSSM Ltd (trading as Eric Liddell Sports Centre)

15.1 Eric Liddell Sports Centre stores personal data carefully. If any member has any questions about a member’s personal data held by Eric Liddell Sports Centre, or wishes Eric Liddell Sports Centre to cease processing a member’s personal data for direct marketing purposes, a member should contact Eric Liddell Sports Centres Manager. Eric Liddell Sports Centres uses personal data about its members, prospective members and former members for the purposes of administering membership (including collecting membership fees and other sums due to vetting people for membership), access control, providing services to members and former members and internal administration such as training, detection and prevention of crime (for which we do have CCTV monitoring in certain places). Where the information is sensitive (for example health and medical details) Eric Liddell Sports Centre take extra care of this information and do not pass it to any parties except to businesses within Eric Liddell Sports Centre and successor business of ours. Other information, may be passed to contracting parties.

16 Governing Law and Jurisdiction of the Courts

16.1 This agreement shall be governed by and construed with.

Direct Debit Guarantee

– The Guarantee is offered by all banks and building societies that accept instructions to pay Direct Debits

– If there are any changes to the amount, date or frequency of your Direct Debit the organisation will notify you (normally 10 working days) in advance of your account being debited or as otherwise agreed. If you request the organisation to collect a payment, confirmation of the amount and date will be given to you at the time of the request.

– If an error is made in the payment of your Direct Debit, by the organisation or your bank or building society, you are entitled to a full and immediate refund of the amount paid from your bank or building society – If you receive a refund you are not entitled to, you must pay it back when the organisation asks you to.

– You can cancel a Direct Debit at any time by simply contacting your bank or building society. Written confirmation may be required. Please also notify the organisation.
